These Terms of Use apply to Boingly, playboingly.com, and related support services provided by The Wavering Line LLC, a Kansas limited liability company. By downloading, accessing, or using Boingly, you agree to these Terms.
Apple App Store Terms
Boingly is distributed through the Apple App Store. Your use of Boingly is also subject to Apple's App Store terms and Apple's Standard Licensed Application End User License Agreement (the “Apple Standard EULA”). These Terms supplement, and do not replace, the Apple Standard EULA. If there is a conflict, the Apple Standard EULA controls where required by Apple's terms.
Apple is not responsible for Boingly, its content, support, maintenance, warranties, or claims, except as provided by applicable Apple terms. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to Boingly distributed through the App Store.
Boingly Pro Purchase
Boingly may offer a one-time, non-consumable in-app purchase called Boingly Pro for $1.99 USD. Boingly Pro unlocks the full adventure and Pro character styles described in the app. This is not a subscription.
Purchases are processed by Apple through your Apple ID. Prices may vary by country, currency, taxes, and App Store pricing rules. Payment, refunds, family sharing availability, purchase history, and restoration are handled by Apple under Apple's App Store policies. If you delete or reinstall the app, use the restore purchase option where available or Apple's purchase tools to restore eligible purchases.
License
Subject to these Terms and the Apple Standard EULA, The Wavering Line LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Boingly for personal, non-commercial entertainment purposes on Apple-branded products that you own or control, as permitted by Apple's usage rules.
Ownership
Boingly, including its characters, artwork, gameplay, code, audio, names, logos, designs, and other content, is owned by The Wavering Line LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Boingly except as allowed by law.
Acceptable Use
- Do not use Boingly for unlawful, harmful, or abusive purposes.
- Do not attempt to bypass purchases, unlocks, security, or technical limitations.
- Do not interfere with the app, website, App Store systems, or support channels.
- Do not misrepresent your relationship with The Wavering Line LLC, Apple, or Boingly.
No Gambling or Prizes
Boingly is an arcade entertainment game. It does not offer real-money gambling, lotteries, sweepstakes, cash prizes, or redeemable virtual currency.

For support, contact support@playboingly.com. We try to respond to reasonable support requests, but we do not guarantee that support will be available at all times or that every issue can be resolved.
Updates and Changes
We may update Boingly to add, change, or remove features; fix bugs; adjust gameplay; or maintain compatibility with Apple platforms. We may also update these Terms from time to time. Continued use after changes means you accept the updated Terms.
Disclaimer of Warranties
Boingly is provided “as is” and “as available.” To the maximum extent permitted by law, The Wavering Line LLC disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.
Limitation of Liability
To the maximum extent permitted by law, The Wavering Line LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to Boingly or these Terms. Our total liability for any claim will not exceed the amount you paid for Boingly Pro, if any, or $1.99, whichever is greater. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.
Governing Law
These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict-of-law principles, except where consumer protection laws require otherwise.
